SAFTU notice to strike - socio-economic demands
The South African Federation of Trade Unions (SAFTU) has given notice of the intention to proceed with protest action and to call workers and the working class to support a day of protest. The protest is in response to the difficult socio-economic conditions of workers, and is scheduled from 00h05 until 23h55 on Wednesday 29th November 2023. Please see notice attached.
In terms of the Labour Relations Act (LRA) Act 66 of 1995, a union federation has the right to protest on socio-economic grounds, pursuing improvement of conditions for the working class. SAFTU followed the necessary process in terms of s77(1)(b) of the LRA by tabling their demands at the National Economic and Development Labour Council (NEDLAC) https://nedlac.org.za/ , see attached NEDLAC Protocols.
The NEDLAC Act 35 of 1994 envisions a body where government, business, labour, and civil society are intended to jointly resolve issues - such as the demands tabled by SAFTU, with the intention of minimising industrial action. SAFTU was admitted to NEDLAC on 1 February 2023 https://bit.ly/40Zgcpl, where their demands were tabled.
NEDLAC issued the certificate confirming the process and the failure to resolve the demands. Consequently, SAFTU is entitled to proceed with the protest action in pursuit of socio-economic demands. See attached notice.
For employers, the recommended approach is advise employees - in advance - that the response to absenteeism on that day will be: no work, no pay, and no disciplinary action will be taken for staying away. However, disciplinary action may be taken for any misconduct. Employees need to be made aware that the day will not count towards accumulation of annual leave, or any attendance type bonuses.
