Description

Mandatory Grants, Discretionary Grants, Skills Development Levies (SDL), SIC Codes, Inter-Seta Transfers.

Watching various news media reports, there appears to be some confusion over the difference between the definition of a Sector Education and Training Authority (SETA), and a SETA Accounting Authority (AA). 

The difference was not clear in the original Skills Development Act 97 of 1988.

SETAs are covered in Chapter 3 of the Skills Development Act, Sections 9 to 15.

There are 21 SETAs, and each SETA has an AA. The AA is what was previously called the Board of the SETA.

From the early years of skills development – after the 2000 implementation, there has been a succession of media headlines involving Sector Education and Training Authorities (SETAs), involving various forms of mismanagement of funds. Ministers Mdladlana and Nzimande, particularly, have responded by implementing amendments to the Skills Development Act 97 of 1998, in 2003, 2008, and 2011, attempting to establish better financial controls. 

But it seems we are never entirely free of the headlines.

I have been asked a question that I can't answer:
Where does the legal requirement come from for learners to submit personal details - such as ID documents - with their Portfolios of Evidence?

What does an employer or a training service provider do if a learner refuses to provide such personal information - on the basis that they are not sure whether their identity will be protected, and that their identity could be stolen?

Is the requirement from the Auditor General/PFMA because it doesn't seem to be in the SDA or regulations?

President Jacob Zuma has in terms of section 2 (2) of the Special Investigating Unit and Special Tribunals Act, 1996, signed a Proclamation authorising the Special Investigating Unit (SIU) to investigate certain matters in respect to the affairs of the Public Service Sector Education and Training (PSETA).

The Proclamation authorises the SIU, amongst others, to investigate the following allegations:

(a) Serious maladministration in connection with the affairs of the PSETA.

(b) Improper and unlawful conduct by employees or officials of the PSETA.

Since the WSP and ATR is now completed on line for most SETAS I was wondering if anyone has electronic copies of a WSP and/or ATR for different SETS. If you have such a thing or can direct me to contacts at the various SETAS who can provide these then please make contact with me or provide the information.

The National Skills Authority (NSA) has prepared a video explaining their mandate, and how the Department of Higher Education and Training (DHET) under Minister Nzimande has worked to improve the contribution of the Sector Education and Training Authorities (SETAs).
The NSA & DHET hosted a National Skills Conference where researchers were able to share their research on how the SETAs contribute to skills development for the labour market.

I would love some advice from any legal eagles in the group...

Recently our SETA is refusing to issue certification unless we email to them certified copies of Learners ID's, Enrolment Forms, and Highest Qualifications held.

Now I have a few major issues with this. Not that they want the info, but how they want it... Actually I do have an issue with them wanting it.

New here, so not sure if I can post a question here. Trying to register as an assessor with various SETA'S. - where is the best place. to search for qualification Ids & unit standard codes??? Or the best way to find these. I know the general topic which I want to register but might not know exact unit standard name or levels? Can anyone kindly point me in the right direction. Tks.
