With you 100% Sylvia. Regarding the task and roles as you mention I find the OFO’s are of great assistance in ensuring some form of standardisation. So in reality the Act and particularly section 20 (3) as you have outlined it, must be used as the guide and if the job profiles have been reviewed and the OFO’s incorporated we have a very strong…[Read more]

Des, My opinion is that unfortunately we have another one of those situations, where there is more than one answer.
Regarding formal qualifications:
* on the one hand, I fully support the drive to allow people to acquire accredited portable qualifications, that is part of redress for those who were excluded from acquiring formal qualifications.…[Read more] -

I agree Sulvia, It comes down to ability to do the job (having the correct comptencies) and not the education. It is for this reason that companies are required to review all policies and procedures. The recruiting, selection or promotion policy needs to cover this aspect and remove the education barrier.
How many companies have doen this I wondeer??

Hi Des,
Thank you for posting this question. It is very interesting. If a company requires a certain level of qualification – such as a matric, the question is – who are the people who are most likely to be excluded by that standard?
There is no question that it would be those people, who previously received the most poorly funded education -…[Read more]

Discrimination is illegal and is prohibited in any form in terms of the EE Act.
Would a company then be discriminating when they advertise for vacant positions, or when thy promote based on minimum educational requirements???
Give this some thought and plese explain yuor responses.

Thanks Heidi,
I have received this response.“Q: Should I include payments received from UIF TERS as remuneration when I calculate ETI?
A: Payments from UIF TERS directly to the employer, who will in return pay the employees are exempt and does not form part of remuneration. These payments must be excluded for purposes of ETI…[Read more] -

Good day,
All registered Accountants and Tax Practitioners would have received a communication in this regard.
There are a number of possible answers, tied to a number of scenarios.
1. If the employer paid / declared a reduced salary and still claimed TERS.
2. If the emplouyer paid / declared a full salary and still claimed TERS.
3. If the…[Read more] -

At this time of year – many questions arise from practitioners completing the Employment Equity reports.
The EEA4 part of the report deals with the payments to employees.
This year there is an added complication. The TERS payments.
The questions is: should the TERS payment to an employee be included in the remuneration?
Is this the correct…[Read more] -

Maryna, I have exactly the same concern. When you think how it usually is – very large gatherings at each national urban centre.
Now they all have to be accommodated in one webinar – and in addition to stakeholders, consultants, lawyers who are the implementers, there will also be the media, and then all the company representatives.
I don’t know…[Read more]

Thanks Des,
It is unfortunate that there has been so little change since 2000 when we implemented the EE Act & the reports started – that is according to the last Employment Conditions Committee report.I have not seen one for this year yet. I am interested to see what progress has been made.
Although my concern will be that these changes just…[Read more]

Thank you for this important up date Sylvia. It concerns me that some of the changes will give the minister sweeping powers and at the same time the bill seems to be very much weighted in favour of the employees and detrimental to the employer. some sections need very careful study. I must say I would be initially inclined to fight against these…[Read more]
