DEL confirm EE Amendment Act not yet implemented - implications

The Department of Employment and Labour (DEL) has confirmed that the Employment Equity Act Amendments (Act 4 of 2022) are not yet implemented. 

Consequently, the small employers who are currently designated employers in terms of the existing Employment Equity Act (1-49 employees and included by turnover under Schedule 4) are still required to submit their annual reports. That is: they are required to complete and submit the EEA2 and EA4 forms.

The following submission dates will apply: (Click title for full report)

Reporting opens 1 September, 2023 - for online and manual reports, and DEL will send the online activation email to employers before 1 September, 2023.

Manual reporting closes 2 October, 2023.

Online reporting closes 15 January, 2024 (midnight).

Failure to report annually means that the employer will not be included in the annual report of compliant employers, and will leave the employer open to penalties and enforcement processes under the existing EEA. The exclusion may potentially prejudice future business operations.
